Most truck drivers are required to travel for many hours to transport their cargo. This can lead some drivers to become fatigued and although both federal and state regulations require commercial drivers to take regular breaks, many fail to take these precautions.

7 of the Most Common Causes of Truck Accidents

There are a number of other common causes of truck accidents, including:

  1. Speeding – Excessive speed reduces a truck driver’s ability to react to sudden changes on the road and increases the severity of accidents.
  2. Fatigue – Long hours on the road can lead to driver fatigue, impairing reaction times and decision-making abilities.
  3. Improperly loaded cargo – Incorrectly loaded or unsecured cargo can shift during transit, leading to loss of control, rollovers, or spills.
  4. Improper maintenance – Inadequate vehicle maintenance, including faulty brakes, tires, or lighting systems, can contribute to accidents.
  5. Distracted driving – Activities such as texting, talking on the phone, eating, or using electronic devices can divert a truck driver’s attention and increase the risk of accidents.
  6. Tailgating and Improper Lane Changes: Following too closely and improper lane changes by truck drivers can result in collisions, especially given their larger size and longer stopping distances.
  7. Driving under the influence – Operating a truck under the influence of alcohol or drugs significantly impairs a driver’s judgment and coordination.

Some truck accidents are caused not by a truck driver’s negligence, but by another driver’s failure to take reasonable care when driving near a big rig. The most common unsafe acts committed by drivers in the vicinity of large trucks include:

  • Changing lanes abruptly in front of a truck;
  • Misjudging a truck’s speed and turning left in front of it;
  • Improperly merging;
  • Driving in the areas behind and beside a truck where the driver has no visibility;
  • Unsafely passing;
  • Being blown out of position by air turbulence created by a truck when improperly passing;
  • Driving between large trucks; and
  • Failing to move a disabled car completely off the road.

These negligent actions by other drivers on the road can create a chain reaction involving collisions between multiple vehicles, including any commercial trucks that were in the vicinity. Multi-car pile-ups are especially dangerous and are more likely to result in death than are other types of car crashes.

Common Injuries

Truck accident-related injuries tend to be especially severe due to the larger size of the vehicles involved. For this reason, a truck driver’s negligence can have especially horrific consequences and many victims sustain life-threatening injuries or become permanently disfigured. Commercial trucks weigh thousands of pounds and often carry dangerous cargo. If a truck driver loses control of his or her vehicle, the force of impact can cause heavy cargo, such as cement pipes or lumber to spill onto the roadway, which in turn can cause additional collisions. Most big rigs are also equipped with larger gas tanks that are more likely to cause explosions after a collision. Broken glass and metal shards can also cause deep and severe lacerations, many of which leave permanent scars.

Some of the most common injuries caused by truck accidents include:

  1. Spine or neck injuries: The forceful impact associated with larger trucks can cause a victim’s head to snap forward, causing injuries ranging in severity from whiplash and herniated discs to paralysis and nerve damage. While some of these injuries can be mitigated through surgery or therapy, others are often permanent and require that a victim use a wheelchair or other assistive medical devices for the rest of his or her life.
  2. Broken bones: A commercial truck’s size means that an impact with another vehicle can be especially forceful. For this reason, broken bones and dislocations are more common in these types of accidents. Depending on which party of the body was injured, broken bones can take months or even years to fully heal and may require painful surgeries and physical therapy.
  3. Lacerations: Deep cuts caused by flying debris are also much more common in accidents involving large commercial trucks. Serious cuts may require stitches, staples, or surgery and even then may become infected, requiring heavy doses of antibiotics.
  4. Soft-tissue damage: The more forceful impacts involved in truck accidents can also cause serious soft-tissue injuries. Resulting organ damage may cause internal bleeding, which can cause permanent damage or death.
  5. Traumatic brain injuries: These types of injuries are especially serious and often have permanent consequences. Trauma to the brain and skull can cause a range of health problems, including memory loss, paralysis, difficulty speaking, and even death.
  6. Burns: Explosions are much more likely to occur in truck accidents due to ruptured gas tanks caused by higher impacts. These risks are heightened by the fact that many trucks carry toxic materials that are highly flammable. Burns are especially prone to infection and may require multiple and painful skin grafts.

Damages

Treating these types of injuries can quickly overwhelm a victim’s finances as medical expenses may include the cost of:

  • Emergency treatment;
  • Follow-up appointments;
  • Diagnostic tests;
  • Prescription medications;
  • Reconstructive surgeries;
  • Rehabilitative therapy; and
  • Nursing care.

While medical expenses may be one of the largest costs associated with serious injuries, they are unfortunately not the only costs that an accident victim may be required to pay. For example, many injured parties are injured so severely that they are unable to return to work for months or even years. This is especially common in accidents that involve trucks, due to the higher likelihood that the injuries will be serious and require intensive medical care. A victim’s spouse, partner, or other relative may also be required to take a leave of absence to transport an injured loved one to and from appointments or to help with daily tasks. This lack of an income can be extremely detrimental to a family who is still trying to pay off medical bills. With life-threatening injuries, such as paralysis, a family may also need to hire a nurse to help with everyday tasks, including bathing, preparing meals, shopping, and driving.

Modified Comparative Fault

Nevada adheres to the legal theory of modified comparative fault, which means that an injured party who contributed to an accident can still recover compensation for his or her injuries. The amount that an injured party will be able to recover will be decreased by his or her percentage of fault in causing the accident.

Federal and State Regulation

Because interstate transportation of commercial goods is so important to the U.S. economy and also poses a significant safety risk to other drivers, both state and federal regulations require drivers to meet certain standards.  For example, big rig drivers must adhere to specific rules regarding:

  • Maximum driving time;
  • Loading procedures;
  • Cargo weight limits;
  • Preventing driver fatigue;
  • The condition of the trucks;
  • Regular safety inspections; and
  • Careful operation of the vehicles.

According to the Federal Motor Carrier Safety Administration (FMCSA) drivers of commercial trucks:

  • Are not permitted to begin a shift without having had at least ten consecutive hours off duty;
  • May not operate a truck after having been on duty for 60 hours within the last seven consecutive days, or 70 hours in an eight day time period;
  • Can only drive a total of 11 hours during a 14 hour work shift; and
  • Are not permitted to drive for more than eight hours without a 30 minute rest break.

Truck drivers are also subject to stricter alcohol regulation. For example, most individuals are not permitted to drive with a blood alcohol concentration (BAC) of 0.08 or more. Commercial truck drivers cannot report for duty, remain on duty, or drive with a BAC of 0.04 or greater.
Nevada law also regulates the amount of weight a commercial truck can carry, maintenance and repair rules, and driver eligibility requirements. For example, truck drivers must have a commercial driver’s license and must be over the age of 21 years old (or over the age of 25 years old for trucks that are 70 feet or longer).

Liability

In some cases, a truck driver’s operation of a vehicle is not the cause of an accident. Instead, the fault may lie in his or her failure to to properly load the truck or ensure that it was running safely. A driver’s negligence can open him or her up to liability for any injuries sustained as a result of the accident. But a truck’s driver is not the only individual who can be held responsible. For example, a trucking company can be held liable for a driver’s negligence if it failed to enforce regulations or inadequately trained its employees. Manufacturers or distributors of hazardous materials can also be held liable for a truck accident if they failed to warn the trucking company or driver of the potential dangers involved in transporting the product.

Investigating the Accident and Injuries

Fortunately for victims of truck accidents, there are a number of tools that can help in the investigation. Trucking companies are required by law to keep detailed driver logs and maintenance records. Many trucks carry black boxes that can record valuable data about accidents and driving habits.
